The 8th Circuit Court of Appeals decided a wetland case on April 10 that may prove to be very beneficial for home builders and developers. If a property owner obtains a final jurisdictional determination (j.d.) that concludes the property in question is a wetland that falls under federal jurisdiction, can the owner dispute the j.d. in federal court?
